Recap of the BHA Community Meeting and Social Hour

On July 18th, the Brickell Homeowners Association had an incredible night with community members, city leaders, state representatives, board members, and residents. The event featured a sold-out room, and the Brickell Flatiron proved to be an exceptional host. From safety to concierge services, the BHA was immensely grateful for the hospitality and professionalism provided by the Brickell Flatiron team, a KWPMC building.

Representative Lopez discussed the "perfect storm" in the current condo crisis impacting our communities, highlighting three major issues:

1. Rising Cost of Insurance

  • The escalating cost of insurance has been a significant burden for condo associations.

2. My Safe Florida Condo Pilot Project

  • Initially, this program provided free inspections for homeowners of single-family homes or townhomes, assessing roofs, exterior doors, and windows. If upgrades were needed, homeowners could apply for a $10,000 grant, which helped slightly lower insurance premiums.

  • As of July 1st, the Pilot Program has been extended to condominiums. Starting in September, condo associations will be able to apply for this grant. However, a united consensus among homeowners is required to proceed with the application.

3. Recertification Special Assessment and SIRS Report

  • The inability to waive the SIRS (Structural Integrity Reserve Study) report requirement is a pressing concern.

  • By the end of this year, every building with three or more stories must have a completed SIRS report. As a condo association you must show you are responsible by being proactive in reaching out to the companies who provide this service.

Clarification on SIRS Assessment Inclusion in Budgets:

For those who have already completed their SIRS:

  • The Structural Integrity Reserve Study (SIRS) must be conducted every 10 years.

  • The budget for the year 2024 is not required to include the SIRS assessment.

  • Any budget passed on or after January 1, 2025, must include the SIRS assessment.

  • Begin reserving in 2026

Example:

  • If you pass your budget in December 2024, you do not need to include the SIRS assessment.

  • If you pass your budget in 2025, the SIRS assessment must be included.

4. Deferred Repairs and Maintenance

  • While it is possible to defer repairs and maintenance, it is not recommended to do so.

All of these issues could leave to residents unable to afford the expenses and Terminate their condos. The concept of economic waste and the ability to terminate a condominium with an 80% vote is typically addressed in state condominium laws or statutes. In Florida, for example, this is covered under the Florida Condominium Act, specifically Florida Statutes Chapter 718.

According to Florida Statute 718.117, which deals with the termination of condominiums, termination can be approved with an 80% vote if certain conditions are met, including the economic feasibility of repairs versus the market value of the units.

The meeting continued with Sergeant Mesa, who discussed the safety concerns in our neighborhood. Unfortunately, Commander Valdes was ill and unable to attend.

BK PD Support Team

The BK PD Support Team manages and oversees daily occurrences. Common services and follow-up investigations are handled by a team of 10-20 officers throughout the day, depending on the time.

Daily Homeless Outreach:

This month, they’ve had 62 engagements with homeless individuals, but only 2 accepted services. The team offers services to unhoused individuals on a daily basis. To report and assist a homeless individual, please call the police non-emergency line at 305-579-6111.

Camera Registry Program: Working Together to Keep Miami Safe!

The Camera Registry Program is an initiative by the Miami Police Department aimed at enhancing public safety through community collaboration. By voluntarily sharing the locations of your security cameras, you can help the police gather crucial information when crimes occur in your neighborhood. Here’s how it works:

  • Voluntary Participation: You can choose to share the locations of your security cameras with the Miami Police Department. This information is solely for the purpose of aiding in investigations.

  • Privacy Maintained: Sharing your camera location does not grant the police access to your camera feeds. It simply informs them of where cameras are located, so they can request footage if necessary during an investigation.

  • No Additional Cost: Participating in the program is free. There are no hidden fees or charges for registering your camera locations.

  • Confidentiality Assured: Your information will be kept confidential. The Miami Police Department will not share your camera location with anyone else and will only contact you if a crime occurs near your camera.

  • Enhanced Crime Solving: By registering your cameras, you help create a network of surveillance that can be crucial in solving crimes quickly and effectively, making your neighborhood safer.
