The Impact of Early Morning & Late-Night Construction and Short-Term Rentals on Brickell Residents

Brickell, known for its dynamic urban lifestyle, is facing increasing disruptions that are affecting the quality of life for its residents. Ongoing construction noise—both late at night and in the early morning—along with the rise of short-term rentals, has led to growing frustrations within the community. These disturbances not only interfere with sleep but also impact residents’ daily routines, mental well-being, and sense of security in their own homes.

Residents in Brickell have been struggling with excessive noise from construction projects that start as early as 5 AM and continue well past legal working hours. The constant drilling, hammering, and heavy machinery operations have made it difficult for people to rest, work from home, or enjoy peaceful moments in their residences.

While development is essential to Miami’s growth, contractors violating noise ordinances are creating an ongoing nuisance that residents should not have to tolerate. Commissioner Joe Carollo’s office, in collaboration with the Brickell Homeowners Association (BHA), is actively addressing these code violations and pushing for better enforcement of construction noise regulations.

Beyond the construction concerns, Brickell has also seen an increase in complaints related to short-term rentals, particularly in condominiums that do not allow them. While vacation rental platforms like Airbnb and Vrbo can provide convenience for visitors, they have also introduced major disruptions in residential buildings.

Some of the most pressing issues reported by residents include:

  • Vulgar and inappropriate behavior in shared common areas

  • Loud parties and excessive noise at all hours of the day and night

  • Increased security concerns due to unknown guests constantly coming and going

  • Property damage and trash left behind by short-term renters

In addition to these disruptions, buildings allowing short-term rentals could be in violation of fire codes. The board and management are exposing residents to tremendous danger and liability by continuing to promote unlawful lodging.

Under Florida law, short-term rentals require different safety protocols, including ADA compliance, to ensure the safety of occupants. However, in many cases, these requirements are being ignored.

Miami-Dade County requires a Certificate of Use (CU) for any property operating as a short-term rental. This certification ensures compliance with local regulations, including zoning laws, safety requirements, and business tax registration. Many condos permitting short-term rentals do not have a valid Certificate of Use, putting them at risk of penalties and legal consequences.

Insurance companies may deny claims if a property is not compliant with zoning and safety regulations. This could leave the management company and board financially responsible for any damages—a serious risk for all involved. Residents should demand compliance with state regulations and condo bylaws to protect their homes and community.

The Brickell Homeowners Association, along with Commissioner Carollo’s office, is working to ensure that these quality-of-life issues are addressed. With stronger enforcement and continued community advocacy, we can help maintain Brickell as a safe, peaceful, and enjoyable place to live.
